I know this is an old thread, and had died a good death...but it was only sleeping.
Rosa, you make some good points about knowing your kids...but therein lies one of the rubs. YOU know them, but the teacher that has them for that academic year does not. So communication between parent and teacher is important.
Additionally, some parents are all about telling their kids what teachers can and can't do. Seriously, for the good of the rest of the student body, these kids should be home schooled. Many of them will take advantage of the information and disrupt the class, knowing that the teacher;s hands are tied, literally, by the law and the administration. For these fine children, at home suspension, with one or the other parent, should be mandatory. Let the same idiots who thought it was such a good idea to let little Johnny know the ins and outs of teacher rules deal with that which they have created.
I like the "fear the unknown" approach myself. Have a conference between you and the teacher. Since you as a parent are the one who knows what a kid fears (getting a cell phone taken away, getting grounded, no access to a computer, and yes, spanking by you as the parent), then, if the kid misbehaves, they know that while teacher might not be able to discipline them, she or he has an even greater weapon...your phone number.
This, of course, relies on you having the "mahbles" (watch "Major League") to be a parent, instead of your kid's older BFF...
